Please read these Terms of Service (“Terms”) carefully before using genewizard.net (the “Service”) operated by Gene Wizard (“we,” “us,” or “our”). By uploading a genotype file and accepting the consent statements at upload, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Nature of the Service — Informational Only

Gene Wizard is an informational tool that analyzes raw genotype data from direct-to-consumer (DTC) genomics companies and whole-genome sequencing files. Results — including pharmacogenomic phenotypes, polygenic risk scores, and trait associations — are provided for personal education and informational purposes only.

Nothing on this Service constitutes medical advice, a clinical diagnosis, a clinical laboratory test result, or a substitute for professional medical care. Do not alter, start, or discontinue any medication, supplement, or medical treatment based solely on results from this Service. Always discuss any significant finding with a qualified healthcare provider or genetic counselor before taking any action.

Pharmacogenomic results should be confirmed by a CLIA-certified clinical laboratory before any prescribing or treatment decision is made.

2. Regulatory Status

This Service has not been reviewed, cleared, or approved by the U.S. Food and Drug Administration (FDA) or by Health Canada. It is not a cleared or approved in vitro diagnostic (IVD) device or laboratory developed test (LDT). It has not been validated in a CLIA-certified laboratory.

The Service is intended solely for personal, non-clinical, informational use.

3. Accuracy and Limitations

Genetic analysis results depend on the quality and coverage of your input data, the limitations of SNP-based genotyping (including inability to detect copy number variants), the current state of scientific knowledge, and the accuracy of third-party databases (CPIC, DPWG, ClinVar, PGS Catalog). Pharmacogenomic star allele assignments assume the absence of untested variants. Results may be incorrect, incomplete, or outdated.

We do not warrant that results will be accurate, complete, or fit for any particular purpose. Published research explains only part of genetic heritability and does not account for all gene-gene or gene-environment interactions.

4. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GENE WIZARD AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO HARM RESULTING FROM DECISIONS MADE BASED ON RESULTS PROVIDED BY THE SERVICE.

You assume full responsibility for any decisions you make based on information obtained through the Service.

6. User Responsibilities

• You must be 18 years of age or older to use this Service.
• You may only upload genotype data that you own or are legally authorized to upload.
• You agree not to use results for clinical decision-making without first confirming them with a qualified healthcare provider and, where appropriate, a certified clinical laboratory.
• You agree not to use the Service for any illegal purpose.

7. Governing Law

These Terms are governed by the laws of Canada and the Province of Ontario, without regard to conflict of law principles.

8. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the date at the top of this page. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
